Terms & Conditions 

These terms and conditions apply to the Book of Alchemy web site located at www.bookofalchemy.com, and all associated web sites linked to www.bookofalchemy.com by Book of Alchemy, its subsidiaries and affiliates, (collectively 'The Site'). Please read these terms and conditions (the 'Terms and Conditions') carefully. BY USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. These Terms and Conditions govern your use of, and any purchase from, the Site, and constitute an agreement between you and Book of Alchemy. By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.. Book of Alchemy reserves the right to change or modify any of these Terms and Conditions or any policy or guideline of the Site at any time, and in its sole discretion. Any change or modification will be effective immediately upon posting of the revisions on the Site. Your continued use of the Site following the posting of its changes or modifications will constitute your acceptance of such changes or modifications. Therefore, you should frequently review these Terms and Conditions and any other applicable policies from time-to-time to understand the terms and conditions that apply to your use of the Site. If you do not agree to the amended terms, you must stop using the Site.  


Product Content, Availability, Pricing and Exchanges/Refunds
Sometimes with the volume of orders we receive, an item shown on the Site may not be in stock before we post a notification on the Site or remove it. If this happens, we will contact you directly to discuss possible options. Data, including prices, may be inaccurately displayed on the Site due to our conversion-system or typographical errors. While we make every attempt to avoid these errors, they may occur. We reserve the right to correct any and all errors when they do occur, and we do not honor inaccurate or erroneous prices. If a product's listed price is lower than its actual price, we will, at our discretion, either contact you for instructions before shipping the product or cancel the order and notify you of such cancellation. If the order has been shipped, you agree to either return the product or pay the difference between the actual and charged prices. Our prices are also subject to change without notice. We offer one free exchange when a ring is ordered in the wrong size. You must contact us within 14 days of receiving the order by e-mail clearly stating that an exchange or return is requested. It is not possible to request an exchange for a different item. After an exchange for a different size is requested and agreed upon by both the customer and Book of Alchemy, Book of Alchemy no longer accepts a return for a refund for that item. When you cancel an order, we reserve the right to deduct a 4% processing-fee of the total amount refunded. When you cancel an order that includes a gold item, we reserve the right to deduct an 8% fee of the total amount of that particulair item. When you cancel an order after it has been shipped, a refund will only be made when the item has been returned to us unworn and without damage (packaging included). Costs of return-shipping are never refunded.
When a package is lost during the shipping-process to the customer, and the customer requests a refund, the refund will only be approved by Book of Alchemy after the shipping agent has completed its protocol regarding the missing package. No refunds will be given before this protocol is completed and any damages claimed by Book of Alchemy have been paid in full by the shipping agent.
Any returns shipped from the customer to Book of Alchemy fall under the responsibility of the customer. Items that suffer damage during return shipping from the customer to Book of Alchemy due to improper packaging will be assessed by Book of Alchemy to establish the repair cost. This amount will be deducted from your total order amount refunded. If a return order is improperly packaged causing the original packaging to be damaged, or returned with incomplete packaging, this will result in a $38 (usd) fee deducted for the total order amount refunded. Any items ordered in a different material than what's offered on our website (For example you request one of our silver rings in gold) are considered a custom order and are not exchangeable nor returnable and will never be refunded. Items that are engraved with a custom image, text or letter(s) are considered custom and are non-refundable. Gift cards are non-refundable. Book of Alchemy is not responsible for any tax or import duty charged on our products when shipping outside of the European Union. General Site Information
We make every attempt to ensure that our online info is as accurate and complete as possible. In order to give you the opportunity to view our products in great detail, some products may appear larger or smaller than their actual size in our photographs; and since every computer monitor is different, color and size may vary slightly. We want to provide you with as much information and detail about your prospective purchase as possible. In compliance with industry standards and FTC regulations, Book of Alchemy states that carat total weight in all purchases may vary 0.05 carats from stated weight. The weight of the item stated in the description is based on a size 62. Weight may vary depending on ring-size. On the Site, we provide the measurement of our products based on our manufacturing specifications. Slight tolerances may be accounted for based on finishing during the manufacturing. For gemstone and pearl measurements, a tolerance of 0.25mm is allowed. For diamond jewelry set with multiple diamonds, we provide the minimum total carat weight for the piece. Color and clarity grades are expressed as either a minimum or an average depending on the number of diamonds. If stated as a minimum, all diamonds within the piece are at or above the stated quality. If expressed as an average, collectively the quality is equal to or exceeds the grade stated.

Policy on Ethical Sourcing
At Book of Alchemy, we purchase diamonds through the largest and most respected suppliers who adhere to and enforce the standards established by the Kimberley Process, an international system that polices the trade of diamonds to ensure they are from sources free of conflict. 

DISPUTES
Any and all disputes and disagreements between us will be governed by laws of the EU, you agree that you will bring any claims only in the Courthouse of Amsterdam. You also agree that unless you are prohibited from law in doing so, you promise you will bring any and all disputes, claims and causes of action against Book of Alchemy individually, without resort to any form of class action. Finally, unless the law prohibits you from doing so, you agree to waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages and you further waive all rights to have damages multiplied or increased.
